Terms of Service

Welcome to CatchTime. These Terms of Service ("Terms") govern your use of the CatchTime application and website at catchtime.app (collectively, the "Service"), operated by CatchTime ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Description of Service

CatchTime is a time tracking and task management application available on Windows, macOS, and Android. The Service includes:

• Automatic application usage tracking
• Task management with categories and statuses
• Time statistics and reports
• Optional cloud sync across devices
• Optional AI-powered activity categorization and daily summaries

2. Accounts

2.1 Account Creation

To use certain features of the Service (such as cloud sync and subscriptions), you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

2.2 Account Termination

You may delete your account at any time through the application settings or by contacting us at hi@catchtime.app. Upon account deletion:

• Your cloud data will be permanently deleted within 30 days
• Any active subscriptions will be canceled
• Local data on your devices will not be affected

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Free Tier

CatchTime offers a free tier with core time tracking and task management features. The free tier is subject to certain usage limitations.

3.2 CatchTime Pro

CatchTime Pro is available as a paid subscription with the following pricing:

• Monthly: $4.99 per month
• Yearly: $39.99 per year

Pro features include enhanced cloud sync, AI-powered features, advanced statistics, and more.

3.3 Payment Processing

All payments are processed securely through Stripe. By subscribing, you agree to Stripe's Terms of Service and Privacy Policy.

3.4 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• Your subscription will automatically renew unless you cancel before the end of the current billing period
• Prices are in USD and may be subject to applicable taxes

3.5 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will retain access to Pro features until the end of your current billing period
• No refunds will be issued for the remaining days of the current billing period
• Your account will revert to the free tier at the end of the billing period

3.6 Refunds

We generally do not provide refunds for subscription payments. However, if you believe you have been charged in error or have exceptional circumstances, please contact us at hi@catchtime.app and we will review your request on a case-by-case basis.

3.7 Price Changes

We reserve the right to modify subscription prices. Any price changes will:

• Take effect at the start of the next billing period after notice
• Be communicated to you in advance via email or in-app notification
• Not affect the current billing period

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to collect data about other individuals without their consent
• Resell or redistribute the Service without our written permission
• Transmit any viruses, malware, or other malicious code through the Service

5. Intellectual Property

5.1 Our Property

The Service, including its original content, features, and functionality, is owned by CatchTime and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Data

You retain full ownership of the data you generate through the Service (tracking data, tasks, etc.). We do not claim any ownership rights over your data.

6. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

7. Disclaimers

7.1 "As Is" Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

7.2 No Guarantee of Accuracy

While we strive to provide accurate time tracking, we do not guarantee that the tracking data will be 100% accurate. Activity tracking depends on operating system APIs and may be subject to limitations.

7.3 Service Availability

We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions for maintenance, updates, or circumstances beyond our control.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CATCHTIME, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or use of our servers
• Any damages resulting from interruption or cessation of the Service

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless CatchTime and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right

10. Third-Party Services

The Service integrates with third-party services including:

• Supabase: Cloud infrastructure and authentication
• Stripe: Payment processing
• DeepSeek: AI-powered features

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with the updated date. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.

If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to the new terms taking effect.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
